BAA, TAA & BABA Compliant Products

Buy American Act (BAA) Compliance Statement
Per the Buy American Act 41 U.S.C. § 10a (2009), the U.S. government should purchase domestic end products unless specific exceptions apply.

The Myers EPS products listed in Table 1 are designed, manufactured, tested, and supported in our Bethlehem, PA facility.  These products are classified as Commercially Off The Shelf (COTS) products because the same products offered to the US Government are sold in the commercial marketplace. Therefore, the products in Table 1 qualify as domestic end products under the Federal Acquisition Regulation (FAR) and are BAA compliant.

Trade Agreements Act (TAA) Compliance Statement
Per the Trade Agreements Act (TAA) 19 U.S.C. § 2511, government contracts that meet the dollar threshold and contain the required TAA clause will only allow procurement of a U.S.- made end product.

The Myers EPS products listed in Table 1 are designed, manufactured, tested, and supported in our Bethlehem, PA facility. These products qualify as US-made end products and are TAA compliant.

Build America Buy America (BABA) Act Compliance Statement
The Build America Buy America Act, enacted as part of the Infrastructure Investment and Jobs Act on November 15, 2021, established a domestic content procurement preference for all Federal financial assistance obligated for infrastructure projects after May 14, 2022. The domestic content procurement preference requires that all iron, steel, manufactured products, and construction materials used in covered infrastructure projects are produced in the United States.

The Myers EPS products listed in Table 1 are designed, manufactured, tested, and supported in our Bethlehem, PA facility. These products qualify as US-made end products and are BABA compliant.
